1. Acceptance of Terms
By downloading, installing, accessing, or using the NightOwl mobile application ("the App") or website, you agree to be bound by these Terms of Service. If you do not agree, you must not use NightOwl.
2. Eligibility (18+ Requirement)
You must be at least 18 years old to access or use NightOwl. By using the app, you affirm and warrant that you are legally an adult. NightOwl is strictly prohibited for minors under the age of 18.
3. Community Standards & Safe Talk
NightOwl is a peaceful sanctuary for authentic connection across Voice Resonance, Silent Telepathy, and The Nests. To preserve this sanctuary, you agree NOT to:
- Harass, bully, threaten, stalk, or intimidate any user.
- Promote, transmit, or solicit Child Sexual Abuse Material (CSAM) or any form of child exploitation.
- Use hate speech, discriminatory slurs, or promote violent extremism.
- Share unsolicited sexually explicit content or engage in non-consensual sexual harassment.
- Record, capture, stream, or broadcast conversations or audio without explicit mutual consent.
- Attempt to unmask, dox, or coerce the real-world identity of other anonymous users.
- Spam, advertise commercial goods, distribute malware, or deploy automated bots.
4. Anonymity and Personal Responsibility
NightOwl provides a zero-identity, privacy-first platform. You maintain sole responsibility for any details you voluntarily disclose to other users during Voice calls, Silent Telepathy chats, or Nest discussions. For your safety, we strongly advise never sharing real names, phone numbers, home addresses, financial details, or social media handles with strangers.
5. Resonance Protocols & Golden Minute
Voice Resonance encounters feature our signature "Golden Minute" harmony protocol. Connections continue beyond 60 seconds only when mutual resonance is reached. Any attempt to abuse, harass, or circumvent matchmaking mechanics will result in immediate suspension.
6. Moderation, Reporting & Account Termination
We reserve the right to suspend or permanently ban any user or device ID at our sole discretion, without notice, for conduct that violates these Terms, our Safety Standards, or threatens community harmony. Users have the right to block and report abusive behavior immediately within the interface.
7. Disclaimers
NightOwl is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not guarantee uninterrupted connectivity or endorse the views expressed by individual users. Use of the service is at your sole discretion and risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Tesla Wizards and the creators of NightOwl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
9. Intellectual Property
All brand elements, visual designs, algorithms, code, and trademarks associated with NightOwl are the exclusive intellectual property of Tesla Wizards and are protected by applicable intellectual property laws.
10. Governing Law
These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
